CROWN LAND OPERATIONAL LAND REVIEW PLAN PUBLIC EXHIBITION

The community is invited to make submissions on the Crown Land Operational Land Review Plan that is currently on public exhibition via Dubbo Regional’s Council’s (DRC) website.

The introduction of the Crown Land Management Act 2016 (CLM Act) has changed management structures for Crown Land, which includes managing crown reserves in accordance with the Local Government Act, 1993. The legislation came into force from 1 July 2017. Included in these changes is the requirement for Plans of Management to be developed and adopted for all Crown reserves classified as “Community.”

DRC’s Manager for Open Space Mr Ian McAlister said Council manages land through a classification as either ‘Operational’ or ‘Community,’ as per the Local Government Act 1993. “DRC has completed an extensive review of the 193 Crown Land reserves that were identified under the new Act as being ‘Community’ land. Following this review 32 reserves have now been identified as being Operational reserves,” said Mr McAlister.

The purpose of classification is to identify land that should be kept for use by the general public (community), such as parks, and land which have a practical purpose with defined public access, such as a rubbish depot or sewage treatment plant.

“Classifying the Crown land reserves does not change the ownership of the land under NSW Government, nor is it the purpose of this review to do so. Additionally, classification of the land does not imply that Council intends to place the land for sale. Ownership of the Crown land remains with NSW Government with the ongoing management of the land by DRC,” said Mr McAlister.

The majority of these 32 reserves that have been identified to be reclassified are currently managed operationally by DRC through corporate strategic and asset management policy. The intention to manage 32 reserves as operational lands has been previously communicated by Council to the Minister for Lands in August 2019.

A 42 day period of public exhibition applies.
